SilverStay Website Privacy Policy

1. About This Policy

This Privacy Policy explains what information Dementia Care Management, Inc., doing business as "SilverStay" ("SilverStay," "we," "us") collects from visitors to silverstay.com, how we use it, and the choices you have. It applies only to our public website.

 

It does not apply to protected health information ("PHI") that SilverStay creates, receives, maintains, or transmits on behalf of hospitals, assisted living communities, or other healthcare organizations we serve as a HIPAA Business Associate. That data is governed by Business Associate Agreements with those organizations and by SilverStay's internal HIPAA compliance program, not by this website policy.

2. Information We Collect

a. Information you provide directly.

 

  • Contact form: name, city and state, email address, phone number, subject, and any message you enter. The form includes a prompt directing you not to include specific health information about yourself or a family member here — see below. If health information is submitted through this form despite that guidance, we use it solely to respond to your inquiry and do not retain it longer than necessary to do so.

  • Referral form ("Submit a Referral"): this form is a clinical intake for patient placement referrals. Fields include: date; referring hospital/SNF staff name and contact information; discharge urgency; patient first name and a shorthand "Patient ID"; family/emergency contact name, email, and phone; current location and desired assisted-living area; expected length of stay; patient age, gender, weight, and height; health insurance type; a free-text description of the clinical event that led to hospitalization and the treatment provided; activities-of-daily-living needs; dementia severity and behavioral risk factors (including wandering and aggression); current medications, including controlled substances, insulin, and chemotherapy agents; a list of potential care challenges (including specific medical conditions such as HIV status, open wounds, and oxygen dependency); ability to pay and payment method; insurance-subsidy application status; and completion status of required hospital discharge forms (HCPPA, TB, MOLST). By submitting this form, you represent that you are authorized to disclose this individual's information for the purpose of arranging their care or placement. This is not incidental collection — it is the form's intended purpose — and it is handled as described in § 6 below, not under the general marketing/analytics practices described elsewhere in this policy.

 

b. Information collected automatically. Like most websites, our hosting platform (Wix) and error-monitoring tool (Sentry) automatically log standard technical data when you visit: IP address, browser and device type, pages viewed, and timestamps. This is used for site operation, security, and troubleshooting — not to identify you personally.

 

c. Cookies. Our website platform (Wix) may set cookies necessary for the site to function (e.g., remembering form state). We do not currently use analytics or advertising cookies on this site (see § 4).

3. How We Use Your Information

We use the information described above to:

 

  • Respond to inquiries submitted through our contact form

  • Operate, secure, and troubleshoot our website

  • Comply with legal obligations

 

We do not sell your personal information.

 

Information submitted through the referral form is used solely to evaluate and arrange patient placement and is not used for marketing, analytics, or any of the general website purposes above — see § 6.

4. Analytics and Tracking

We do not currently use Google Analytics or any other analytics service on this website. We do not use Meta/Facebook or any other retargeting or advertising pixel on this site. If that changes in the future, we will update this section to name the specific service(s) in use and link to that provider's opt-out mechanism.

5. How We Disclose Information

We do not sell or rent your information. We may share it with:

 

  • Service providers who help us operate the website (our hosting platform, Wix) — solely to provide that service.

  • Legal authorities, when required by law, subpoena, or to protect the rights and safety of SilverStay or others.

 

Referral-form information is handled under § 6, not under this general disclosure section.

6. Referral Submissions and Protected Health Information (PHI)

SilverStay is a healthcare technology company that acts as a Business Associate under HIPAA for the hospitals and assisted living communities we serve. The "Submit a Referral" form on this website is SilverStay's designated intake channel for patient placement referrals and is built and hosted within SilverStay's HIPAA Business Associate Agreement–covered infrastructure, including agreements with the service providers we use to process and manage referral information internally.

 

What this form collects and why. Unlike the general contact form on this site, the referral form is designed to collect information about a patient's health, care needs, or placement circumstances — protected health information ("PHI") — submitted by a referring party (such as a hospital discharge coordinator) on the patient's behalf.

 

Authorization. By submitting this form, you represent that you are authorized to disclose the individual's information for the purpose of arranging their care or placement, and that this disclosure is consistent with the individual's rights under HIPAA and any other applicable privacy law.

 

How this information is protected. Information submitted through this form is not used for the general website purposes described in §§ 3–5 of this policy (marketing, analytics, aggregation) and is not subject to those sections. It is handled under SilverStay's HIPAA Security Rule safeguards and internal compliance program, in the same manner as other PHI SilverStay receives as a Business Associate. It is not governed by the general-purpose provisions of this website Privacy Policy.

 

If you are unsure this is the right channel. If you are uncertain whether the referral form is the appropriate channel for a specific patient's information, or need to transmit information that this form does not support, contact your SilverStay point of contact directly rather than using the public website form.

7. Data Security

We use reasonable administrative and technical safeguards designed to protect information collected through this website. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

8. Data Retention

We retain information collected through this website for as long as needed to respond to your inquiry or referral, and as required by law, after which it is deleted or de-identified.

9. Your Choices

You may:

  • Decline to submit information through our contact or referral forms

  • Adjust your browser settings to block or delete cookies

  • Contact us at the address below to ask what information we hold about you or to request deletion, subject to any legal retention obligations

 

Referral-form information is not covered by this section. Information submitted through the "Submit a Referral" form is protected health information handled under SilverStay's HIPAA Business Associate obligations, as described in § 6, and is not subject to the state consumer-privacy rights described below. HIPAA's use, disclosure, and retention rules govern that information — not the deletion or opt-out rights described here.

 

Maryland residents. SilverStay is headquartered in Maryland. The Maryland Online Data Privacy Act (MODPA) grants Maryland residents certain rights — including access, correction, deletion, data portability, and opt-out rights — but only with respect to businesses that meet MODPA's applicability thresholds (35,000+ Maryland consumers processed annually, or 10,000+ combined with revenue from the sale of personal data). Based on silverstay.com's current traffic volume and the fact that SilverStay does not sell personal data, we do not believe either threshold is currently met. We note MODPA here for transparency, not as a claim that its statutory rights currently apply to SilverStay — but consistent with the choices described above, we will honor reasonable requests to access or delete the personal data we hold about you whether or not MODPA strictly requires it.

 

Residents of other states. Based on SilverStay's current business footprint, we are not aware of another state's comprehensive privacy law that applies to this website's data collection. If you believe one does apply to you and want to exercise rights under it, contact us using the information below and we will evaluate your request. Rather than building a separate consent process for a low-volume, incidental channel, our contact form directs health-specific inquiries to our HIPAA-covered referral channel instead — see § 2(a).

10. Children's Privacy

This website is not directed to children under 13, and we do not knowingly collect personal information from children.

11. Third-Party Links

Our website may link to third-party sites (e.g., social media). We are not responsible for the privacy practices of those sites.

12. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last Updated" date below reflects the most recent revision.
